NRA Sues to Overturn San Francisco's Handgun Ban

SAN FRANCISCO —
The National Rifle Association sued the city of San Francisco on Friday to overturn its handgun ban in public housing, a day after the U.S. Supreme Court struck down a handgun ban in the nation's capital.

The legal action follows a similar lawsuit against the city of Chicago over its handgun ban, filed within hours of Thursday's high court ruling.

In San Francisco, the NRA was joined by the Washington state-based Citizens Committee for the Right to Keep and Bear Arms and a gun owner who lives in the city's Valencia Gardens housing project as plaintiffs.

The gun owner, who is gay, says he keeps the weapon to defend himself from "sexual orientation hate crimes." He was not identified in the complaint because he said he fears retaliation.

San Francisco Mayor Gavin Newsom said the city will "vigorously fight the NRA" and defended the city's ban as good for public safety.

"Is there anyone out there who really believes that we need more guns in public housing?" Newsom said. "I can't for the life of me sit back and roll over on this. We will absolutely defend the rights of the housing authority."

San Francisco City Attorney Dennis Herrera said the Supreme Court ruling didn't address gun bans on government property and that he was "confident that our local gun control measures are on sound legal footing and will survive legal challenges."

San Francisco also requires residents to keep guns in lockboxes or equip them with triggerlocks. That law, passed by the county supervisors last year, wasn't challenged in Friday's lawsuit.

A state appeals court has overturned a broader citywide gun ban passed by voters in 2005.

The Chicago lawsuit challenges its 1982 ordinance that makes it illegal to possess or sell handguns in the city.

NRA lawyer C.D. Michel said both lawsuits were necessary to expand the Supreme Court's ruling beyond Washington, a federal district, to states and cities.

"The Supreme Court decisions was very encouraging," Michel said. "But it is just a start."

A Half Victory For Gun Rights

The United States Supreme Court actually did a good thing today by striking down the Washington, DC Gun Ban. More importantly, the court confirmed that the Second Amendment applies to the right of an INDIVIDUAL to possess a gun. Gone are the days of Liberal douche bags jamming the "It applies to the National Guard only" bullshit.

So why do I regard this as a half victory? Because this ruling did not go far enough to overturn the 20,000 or so ridiculous gun laws that are already in the books. This will have the Liberal scum still nibbling our rights slowly away.

But I'll take a half victory over no victory at all.



A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

The Winner: The United States Supreme Court

The Reason: Making it virtually impossible to execute baby rapers.

The Story

Angry politicians vowed to keep writing laws that condemn child rapists to death, despite a Supreme Court decision saying such punishment is unconstitutional.

"Anybody in the country who cares about children should be outraged that we have a Supreme Court that would issue a decision like this," said Alabama Attorney General Troy King, a Republican. The justices, he said, are "creating a situation where the country is a less safe place to grow up."

The court's 5-4 decision Wednesday derailed the efforts of nearly a dozen states supporting the right to kill those convicted of raping a child — and said execution was confined to attacks that take a life and to other crimes including treason and espionage.

At issue before the high court was a Louisiana case involving Patrick Kennedy, sentenced to die for raping his 8-year-old daughter in her bed, an assault so severe she required surgery.

In his majority opinion, Justice Anthony Kennedy wrote "the death penalty is not a proportional punishment for the rape of a child," despite the horrendous nature of the crime.

Republican Louisiana Gov. Bobby Jindal called the ruling "incredibly absurd," "a clear abuse of judicial authority" and said officials will "evaluate ways to amend our statute to maintain death as a penalty for this horrific crime."

Oklahoma officials said they, too, weren't ready to give up, and would "certainly look at what options we have," state senator Jay Paul Gumm said. "I think the people of Oklahoma have spoken loudly that this is one of the most heinous of crimes."

Even White House hopefuls joined the fray. Republican John McCain called the ruling "an assault on law enforcement's efforts to punish these heinous felons for the most despicable crime." Democrat Barack Obama said there should be no blanket prohibition of the death penalty for the rape of children if states want to apply it in those cases.

Forty-four states prohibit the death penalty for any kind of rape, and at least four states besides Louisiana permit it for child rape — Montana, Oklahoma, South Carolina and Texas. There's disagreement over the status of a Georgia law permitting execution for child rape, although Justice Kennedy said in his ruling that it was still in effect.

Following the ruling, all become unconstitutional.

In Texas, Republican Lt. Gov. David Dewhurst said Wednesday that most Texans believe the death penalty is "an appropriate form of punishment for repeat child molesters. Our top priority remains protecting our most precious resource — our children."

But the Texas Association Against Sexual Assault, a nonprofit victim advocacy group representing 80 rape crisis centers, applauded the ruling.

"Most child sexual abuse victims are abused by a family member or close family friend," the group said in a statement. "The reality is that child victims and their families don't want to be responsible for sending a grandparent, cousin or long time family friend to death row."

Nationwide, only two men have been sentenced to death for sexually abusing children — both in Louisiana. The second case involves a man convicted of repeatedly raping a 5-year-old girl. Both men will get new sentences.

Several states, including Missouri, Alabama and Colorado had been considering similar laws.

In South Carolina, Republican Attorney General Henry McMaster said states could ultimately fight Wednesday's ruling by waiting for a change in the makeup of the Supreme Court, or by getting legislatures to redo death penalty laws.

Legal experts were divided on the potential success of such tactics.

According to Douglas Berman, a law professor at Ohio State University, the justices' ruling appears ironclad. "In the absence of death, the death penalty is off the table," he said. The court, he said, "could have left open the possibility of revamping child rape laws, by age for example, but it did not."

Law professor Deborah Denno of Fordham University wasn't so sure. It could be possible to argue for the application of the death penalty against attackers who "intended to kill" their victims, but didn't, she said. Or those who assault especially young children, such as toddlers.


Just think, if Obama wins, he can appoint even more judges like those that decided a baby raper deserves to live.

Texas and New York-Personal Observation

Earlier this month, I went for a long overdue visit to my home state of New York. Besides catching up with the family, and friends I have down there, I made a few personal observations regarding how those two states contrast.

These observations were unaided by the news media, talk show hosts, or political junk mail. This is not scientific, but just things seen personally.

>Both Texans and New Yorkers that I interacted with bitch about the state budget.

>Most Texans hate their governor, including myself, for being an inept, ass-kissing son of a bitch. Most New Yorkers I have talked to have some hope for their new governor because he is the new replacement. Side Joke: How do you slow down a New York prostitute? Put a governor on her.

>Many Texans are spiritual. This is, after all, the "Bible Belt". There is some spiritual growth in New York. I was surprised as hell to see a Southern Baptist Church in Liverpool, New York.

>New York hotdogs and coneys RULE!! Especially Hoffman's. No comment on Texas hotdogs.

>See above comment regarding pizza.

>Texas gun laws are still superior to those of New York. It saddened me walk into a New York gun store, and see the neutered Clintonian style AR style rifles, and low capacity magazines on the shelves. And you still need a permit just to OWN a handgun in New York. Texas allows Class III toys. (To all you shooters who will vote for Obama, please take note)

>Texas self defense laws are superior to those of New York. My New York friends still whine about the "duty to retreat" as opposed to Texas' "Castle Doctrine."

>New York labor laws and protections KILL most of Texas labor policies. Whoever invented the Texas "Free To Work" concept needs to overdose on viagra while locked in a sheep pen. To those who do not know, "Free To Work" means employers can fire you for any or no reason whatsoever. The officer who did my field training in New York was fired three times. Texas also does NOT require a break for employees, something I have seen employers take FULL advantage of.

>Both Texas and New York have an agency that oversees rental properties. But it is the New York agency that actually makes an effort to combat substandard living conditions. In Texas, money really talks. (I hope the Barker Family in Weatherford,Texas is reading this.)

>Texas has Mexican illegal aliens who think we owe them something. New York as every other illegal alien who thinks we owe them something.

>In New York, the affluent really run things. Texans call this system of government the "Good Ole Boy" system. Both states have this.

>Texas teachers bitch about there mere 25K salary. New York Teachers bitch about there mere 53K salary.

>New York has a State income tax. Texas has "service fees". Both rob you blind.

>New York is closing two prisons. Texas prisons are overcrowded. This is because you have to commit a harmful crime to get locked up in New York. In Texas, all you have to do is refuse to sell land to a judge, or divorce a cop's cousin.

>New York civil service workers are actually paid for what they do. Yes, the cost of living is higher, but what they do not mention is that you still have disposable income after all the bills are cleared. Texas is strictly living paycheck to paycheck.

Would I move back to New York? ONLY if they eliminated their gun laws, and went alittle to the Right. Besides that, it is a nicer place to live than my part of Texas. I'd raise my children in Central New York anytime. Not so sure about Texas. Believe it, THIS Conservative is actually thinking of willingly moving to the state that elected Clinton as their Senator. Texas is really starting to suck THAT badly.

Well, sorry for what qualifies as a rant.

12-Year-Old Grounded for Too Much Internet Use Gets Punishment Overturned in Court

A Canadian court has overturned a father's punishment for his daughter after she refused to stay off the Internet, his attorney said Wednesday.

The girl, 12, took her father to Quebec Superior Court after he refused to allow her to go on a school trip for chatting on Web sites and then posting "inappropriate" pictures of herself online using a friend's computer, AFP reported.

The punishment was for the girl's "own protection," according to the father's attorney, Kim Beaudoin, who is appealing the ruling.

"She's a child," Beaudoin told AFP. "At her age, children test their limits and it's up to their parent to set boundaries. I started an appeal of the decision today to reestablish parental
authority, and to ensure that this case doesn't set a precedent."

Otherwise, she continued, "Parents are going to be walking on egg shells from now on."

According to court documents, the girl's Internet usage was the latest in a rash of disciplinary problems. But Justice Suzanne Tessier, who was presiding over the case, found the punishment too severe.
