The Senate Judiciary Committee has postponed the hearing for a controversial Court of Appeals nominee after the panel received a letter from a home-state prosecutor blasting him as a judicial loose cannon and Republicans raised concerns about his alleged bias in favor of sex offenders.

U.S. District Court Judge Robert Chatigny gained notoriety in 2005 for his role in trying to fight the execution of convicted serial killer and rapist Michael Ross, also known as The Roadside Strangler, whom Chatigny had described as a victim of his own "sexual sadism."
His conduct in that case, which included threatening to go after Ross' attorney's law license, as well as his ruling in 2001 against sex offender registries created under Megan's Law, has caused a commotion among Republicans on the judiciary panel.
"I've never seen conduct like this," said a Republican source. "I'm shocked that the White House vetted this guy ... and still put him up for a judgeship."
The nomination is relatively fresh. President Obama submitted his name Feb. 24 for a seat on the Second Circuit Court of Appeals, calling him a "first-rate" legal expert and "faithful" public servant.
With the hearing originally set for Wednesday, Republicans led by their ranking member, Jeff Sessions, R-Ala., said they wanted more time.
"Senator Sessions and the Judiciary Republicans have asked for a delay in light of the nominee's extremely lengthy record and the fact that he was brought up so unusually quickly," Sessions spokesman Stephen Miller said.
Behind the scenes, Republicans are taking a hard look at Chatigny's role in the Ross proceedings which they say could be disqualifying -- particularly on the Court of Appeals, the last line of review before the Supreme Court.
"You're letting him be the final review for a lot of people, and he's shown this alarming bias in sex crime cases," a GOP committee aide said.
Chatigny's office declined a request for comment. The White House could not be reached.
Chatigny stunned those involved in the serial killer case in early 2005 by pressuring Ross' attorney on a conference call to challenge his scheduled execution even though Ross had said he did not want to fight.
The judge had raised concerns about whether Ross was mentally unfit and whether prison isolation had led to despair -- at the time of the conference call, federal appeals courts had overturned two prior orders from him postponing the execution.
According to a transcript of that Jan. 28 call, the judge threatened to go after the law license of Ross' attorney, T.R. Paulding.
"So I warn you, Mr. Paulding, between now and whatever happens Sunday night, you better be prepared to live with yourself for the rest of your life," Chatigny said. "And you better be prepared to deal with me if in the wake of this an investigation is conducted and it turns out that what Lopez says and what this former program director says is true, because I'll have your law license."
Ramon Lopez was an inmate who had written a letter to Chatigny saying Ross had been brainwashed by mental health professionals.
Ross was convicted of killing four women but had confessed to killing eight, raping most of them. He was sentenced to death in 1987 and had been on death row nearly two decades when Chatigny engaged in the last-minute battle with others on the case.
On the conference call, the judge repeatedly stuck up for Ross, saying he suffered from "this affliction, this terrible disease" and suggesting Ross "may be the least culpable, the least, of the people on death row."
"Looking at the record in a light most favorable to Mr. Ross, he never should have been convicted," Chatigny said. "Or if convicted, he never should have been sentenced to death because his sexual sadism, which was found by every single person who looked at him, is clearly a mitigating factor."
In the end, the execution was temporarily delayed and ultimately carried out. But in the aftermath, seven prosecutors from Connecticut filed a complaint against the judge with the Judicial Council of the Second Circuit. Among the complaints were that the judge had threatened Paulding and that he had not disclosed that in 1992 he filed an application to file a legal brief in support of Ross' appeal -- though the judge never ended up filing that brief. He was later cleared of misconduct.
This year, in a letter dated March 5 to Senate Judiciary Committee Chairman Patrick Leahy and Sessions, one of those prosecutors wrote that Chatigny's actions in the run-up to the execution "call into question his suitability" for the Court of Appeals seat.
"Judge Chatigny completely abandoned the role of neutral and detached magistrate and instead became an advocate for the position held by the parties who were seeking to stop the execution of Michael Ross," wrote Michael O'Hare, an assistant state's attorney in Connecticut. He described the Jan. 28 conference call as a "tirade" in which the judge was "threatening and intimidating" others.
After receiving the letter, as well as a request from committee Republicans to postpone, Leahy canceled the Wednesday hearing. According to Leahy's office, the hearing was postponed because of the GOP request and will be held at some point, though it's not clear when.
A Democratic committee aide said Leahy was "happy to accommodate" the Republicans' request. The aide did not discuss whether Democrats share the Republicans' concerns.
"The information related to that case has been in the public domain for quite some time, so it's not like something that's been kept from public view. ... This is why we have nomination hearings," the aide said.
A few years before the standoff over the execution, Chatigny had also issued a ruling that Connecticut's sex offender registry was not constitutional. Though the federal appeals court upheld the ruling, it was later unanimously reversed by the Supreme Court.
The judge does have his supporters. Connecticut Sens. Chris Dodd and Joe Lieberman issued a joint statement late last month saying Chatigny had "consistently demonstrated his impressive legal abilities and a profound commitment to the rule of law."
They called him an "outstanding addition" to the Court of Appeals and pledged to work toward his "swift confirmation" through the Senate.

The allegations are serious, which is why Christian Action Network took more than two years to research Muslims of America—going inside the compounds with their video cameras and questions to confront violence and confirm the truth. However, because of the group’s inactivity during 2000, it was not included in the most recent terrorism report covering that calendar year.’
The effect of being removed from terrorist reports? In January 2002 Wall Street Journal reporter Daniel Pearl was kidnapped and later beheaded while attempting to attend an interview with Jamaat ul-Fuqra leader Sheikh Muburak Gilani.
Was this an isolated incident? Hardly. In March 2003, Fuqra and al Qaeda member Lyman Faris pled guilty in federal court to a plot to blow up the Brooklyn Bridge, and the list goes on.

Democrat Deregulators

WASHINGTON -- How is it that Republican presidential candidate Senator John McCain has been badly damaged by this financial crisis while the Democratic presidential candidate, Senator Barack Obama, is successfully presenting himself as a financial genius, capable of working Christ’s miracle of the loaves and fishes on our economy?
The financial markets froze up because the Democrats prevailed on mortgage lenders -- mainly Freddie Mac and Fannie Mac -- to relax standards against thitherto unqualified property buyers. They did it out of an ideological commitment to their thesis that poor people living in private homes would be better citizens. It was a noble vision. Yet it was economically untenable. A huge real estate bubble resulted, and now that the bubble has burst the entire economy is imperiled.
Curiously, the Democrats have not suffered the consequences of their “deregulation” of the mortgage market. Instead, they have hung the “deregulation” canard on McCain. As the record makes clear, it is McCain who signed on to a letter with 19 other Republican senators in 2006 calling for the tightening up of Fannie and Freddie’s loans. Even before that, in the summer of 2005, Republican Senator Richard Shelby fashioned a bill in the Senate Banking Committee to impose stricter regulations on Fannie and Freddie only to see it blocked from getting to the Senate floor by a party line vote that kept it in committee. The Republicans favored this regulation tightening. The Democrats opposed it.
In an early example of his slipperiness, Senator Obama stood with his fellow Democrats in opposing the bill. Then he went on record opposing his own vote by writing the Secretary of the Treasury that subprime mortgages are dangerous. As has been said of other evasive politicians, Obama is a chameleon on plaid. Apparently a chameleon on plaid can escape the media’s accountability even as he boldly opposes stricter regulations on subprime loans while writing the Treasury to oppose such loans. Yet how is it that the media have given the entire Democratic Party a pass on their advocacy of subprime loans?
As this election grinds on I am frequently reminded that voters are not getting the whole story, that coverage is amazingly slanted towards an inexperienced Obama who, incidentally, comes from a very dubious background. I have been especially aware of this since September 26. That was when The American Spectator online reported that Senator Obama’s longtime political supporter and present National Finance Chair gutted a Chicagoland bank by recklessly extending the kind of dubious loans that have caused today’s financial crisis.
Penny Pritzker, from her position on the board of the holding company controlling Superior Bank, approved of risky loan practices that eventually cost depositors hundreds of millions of dollars. Superior had been unable to make money with traditional safe loans, so Ptitzker encouraged the bank to enter the subprime market. Then she defied regulators who told her the bank’s practices were reckless. After the bank failed in 2001 and government investigators examined the corpus delicti, the wealthy Pritzker family ended up paying $460 million in penalties over a 15-year period.
Nonetheless, when it came to selecting his finance chair, candidate Obama chose Penny Pritzker. Now, with not a peep of recognition from the media, he abominates Wall Street for practices she pioneered. He claims Republican aversion to regulation led to this financial crisis. Yet the record is clear. In the finance sector it is the Republicans who favored regulation and the Democrats who thwarted it. If the media remain mum on all this, these same Democrats will control two branches of the federal government soon. Maybe they will make Penny Pritzker secretary of the Treasury.

The nation's largest group of atheists and agnostics is suing President Bush, the governor of Wisconsin and other officials over the federal law designating a National Day of Prayer.
The Freedom From Religion Foundation sued Friday in U.S. district court, arguing that the president's mandated proclamations calling on Americans to pray violates a constitutional ban on government officials endorsing religion.
The day of prayer, held each year on the first Thursday of May, creates a "hostile environment for nonbelievers, who are made to feel as if they are political outsiders," the lawsuit said.
The national proclamation issued this year asked God's blessings on our country and called for Americans to observe the day with appropriate programs, ceremonies and activities.
Wisconsin Gov. Jim Doyle is named in the suit because he is one of 50 governors who issued proclamations calling for the prayer day. The foundation is based in Madison.
Shirley Dobson, chairwoman of the National Day of Prayer Task Force, and White House press secretary Dana Perino also are named.
The foundation has filed numerous lawsuits in recent years, including one rejected by the U.S. Supreme Court last year that attacked President Bush's faith-based initiative.
The White House and Doyle spokesman Lee Sensenbrenner had no comment on the lawsuit. A message seeking comment from the task force was not returned Friday.

Pelosi and Reid Blew It

The most fascinating political development of the summer has occurred with little notice. Republicans are respected again. Wait, what?
Believe it or not, entering the final quarter of the eighth year of the George W. Bush presidency, Republicans are ascending in popularity, Politico.com reported yesterday. Half of registered voters and half of independent voters have a favorable opinion of the GOP, according to a new poll from the Pew Center for the People and the Press. Democrats hold a slight edge in favorability among registered voters (55 percent to 50 percent), but they are statistically tied with Republicans among independent voters (Republicans 50 percent, Democrats 49 percent.)
How could this happen? Anyone half-paying attention for the past eight years can rattle off the list of reasons voters are supposed to be fleeing the GOP: Iraq, Katrina, Wall Street, Abramoff, DeLay, Bridge to Nowhere, bin Laden at large, gas prices, and home mortgages. When Democratic presidential candidates dream, they dream of election years like this one.
And yet since August the Republicans have closed an 18 point gap with Democrats among independent voters. A new Gallup poll finds that Democrats have only a three-point edge (within the margin of error) when people are asked which party they want to control Congress.
I think the answer is pretty clear: The Democratic leadership in Congress took the golden opportunity it was given in 2006 and pissed it away on petty partisanship -- just like the Republicans who preceded them did.
A Gallup poll out this week is revealing. It found that only 47 percent of Americans say they have trust in the legislative branch of the federal government. That's the first time that number has dipped below 50 percent since Gallup began asking that question in 1972. The same poll found that only 18 percent of Americans approve of the job Congress is doing vs. 31 percent who approve of the job President Bush is doing.
There is good reason for those low ratings. When voters swept Democrats into power two years ago, they expected that the party would deliver on its promises. It hasn't. Instead of leadership and statesmanship, we got gamesmanship. Instead of governing, Nancy Pelosi and Harry Reid embarked on a two-year political campaign.
The Democrats opposed the troop surge in Iraq. When the surge turned a raging insurgency into a slinking retreat and the Democrats ridiculously proclaimed that it wasn't working, an average American listening to both sides could only shrug his shoulders and wonder what in the world the Democrats were smoking.
When Democrats opposed every measure to increase domestic oil production, they angered millions of Americans. And when they finally tried to claim they were for new drilling by producing two bills that allowed new drilling only where there was little or no oil, Americans quickly picked up on the scam.
On all of the major issues of the past two years, the Democrats chose to play political gotcha instead of actually govern. The public, it turns out, seems to have seen through the charade. It's kind of hard to convince Americans that you feel their pain when, for example, you are doing everything in your power to keep gas prices high through the election. By being Democrats first and public representatives second, Democrats have lost the enormous advantage in goodwill the Republicans handed them on a silver platter two years ago.
This election year should have produced a Democratic sweep of historic proportions, delivering the White House and massive majorities in the House and Senate. But thanks to the incompetence of Nancy Pelosi and Harry Reid, Republicans might pull a respectable showing.

Report: Kentucky Grants Partial Pardons to 8 Convicted Murderers, 14 Rapists
FRANKFORT, Ky. —
Gov. Steve Beshear has granted partial pardons to at least eight convicted murderers and 14 rapists over the past five months, allowing them to vote and run for office.
Kentucky Department of Corrections records provided to The Associated Press show that Beshear also granted partial pardons to 23 people convicted of felony sexual abuse.
Beshear has taken action on behalf of 747 released convicts since March, when he streamlined the process for felons seeking to have their civil rights restored.
"Those whose rights have been restored have served their time and paid their debt to society," Beshear said in a written statement. "The primary goal of the corrections system is to rehabilitate those who have committed crimes and return them as contributing members to society."
In Kentucky, convicted felons permanently lose their civil rights unless the governor intervenes.
To make it easier to regain voting privileges, Beshear dropped requirements that felons submit three letters of recommendation and write essays explaining why their requests should be granted.
Some prosecutors object to granting the partial pardons to people convicted of violent crimes.
"In my mind, I never believed those would be the types of people who would be given serious consideration," said prosecutor Linda Tally Smith, former president of the Kentucky Commonwealth's Attorney's Association. "I would think the person who fell victim to these offenders would expect they would continue to be treated as the violent offenders that they are."
"It is a strenuous process," he said.
In Alabama, the American Civil Liberties Union filed a lawsuit last week asking that convicted felons be allowed the right to vote unless they were convicted of one of 15 crimes — including murder, treason and some sex crimes — cited in state law as reasons for denial.
In Florida, more than 115,000 former felons who completed their sentences have had their civil rights restored since a new state rule went into effect last year. The rule restored rights almost automatically, ending a policy of requiring the Board of Executive Clemency to act individually on every restoration of rights request.
Some Kentucky lawmakers have been pushing for a constitutional amendment under which some felons would automatically have their right to vote and serve in public office restored after they complete their sentences. Those convicted of murder or sex offenses would have been excluded under the measure that passed the House only to die in the Senate.
If it had passed, the measure would have been put on the ballot for Kentucky voters to ratify or reject.
State Rep. Jessie Crenshaw, D-Lexington, has pushed the legislation in each of the past three sessions. While it failed each time, Crenshaw said support seems to be growing.
"It is a controversial issue," Crenshaw said.

Berkeley City Council Moderates Anti-Marine Position

(CNN) -- The Berkeley City Council voted early Wednesday to rescind a previous vote that said Marine recruiters are "not welcome in this city," but held tight to its anti-war stance.
The vote came after more than three hours of animated citizen input and council debate. More than 100 speakers took turns at the podium. Each speaker was given up to a minute to comment.
In a 7-to-2 vote, the council said it would no longer send a letter to the local Marine Corps Recruiting Station and Marine Corps Commandant Gen. James Conway saying recruiters aren't welcome in Berkeley.
Instead, the city is now simply stating it's opposed to the war and the billions spent on it. However, "we recognize the recruiter's right to locate in our city and the right of others to protest or support their presence," the council said.

Ahead of the vote, passions ran high on both sides of the debate as pro-military demonstrators squared off with anti-war protesters. Berkeley police reported four arrests before the meeting began, all misdemeanors. Police said there were minor scuffles between the anti-war and pro-military camps.
An American flag was set aflame outside the City Council chambers, damaging a pair of bicycles, police said.
Inside, members of the anti-war group Code Pink lined up at the podium to speak. Their salmon-colored signs read, "Berkeley says No to War" and "City Council - We have your back."
But others scolded the City Council. "City Council -- shame on you," said one sign, and "Don't surrender to terrorists," read a T-shirt worn by a Vietnam veteran.
Debbie Lee, whose son Marc was the first Navy SEAL to die in the Iraq war, demanded an apology from the council.
"My son gave up his life for you," Lee told the council as she clutched his framed picture.
"I'm appalled at what you did," she said, referring to the council's vote on Marine recruiters.
"It's despicable what you said about our military," said another military mom, Debbie Parrish. Her son, Victor, currently serves in Iraq.
"It's very, very sad. Shame on you."
But Jean Stewart called the council's stand "courageous and gutsy," saying the war was "immoral." And Judy Christopher said, "We need to stop the war. We need to stop recruitment."
In the measure passed by the council on January 29, Marine recruiters were called "uninvited and unwelcome intruders."
It went on to say the council applauds residents and organizations that "volunteer to impede, passively or actively, by nonviolent means, the work of any military recruiting office located in the City of Berkeley."
Protesters with Code Pink have been camped outside the Marine recruiting office on Shattuck Avenue for the last four months, singing peace songs and chanting slogans for an end to the Iraq war.
Republican lawmakers in Washington fired back last week, threatening to recall more than $2 million of federal funding to the city as well as money designated for the University of California-Berkeley, the campus that became a bastion of liberalism during the Vietnam War.
The Marine Corps has said it has no plans to move its office, which is located about a block from the college campus.

BERKELEY, Calif. — Local officials in this liberal city say it's time for the U.S. Marines to move out.
The City Council has voted to tell the Marines their downtown recruiting station is not welcome and "if recruiters choose to stay, they do so as uninvited and unwelcome guests."
The measure passed this week by a vote of 8-1.
The council also voted to explore enforcing a city anti-discrimination law, focusing on the military's "don't ask, don't tell" policy.
In a separate item, the council voted, also 8-1, to give protest group Code Pink a parking space in front of the recruiting office once a week for six months and a free sound permit for protesting once a week.
Marine Capt. Richard Lund of the recruiting office declined comment on the council action.
The recruiting office opened in Berkeley about a year ago, operating quietly until about four months ago when Code Pink began regular sidewalk protests.
"I believe in the Code Pink cause. The Marines don't belong here, they shouldn't have come here, and they should leave," said Berkeley Mayor Tom Bates.
Code Pink is circulating petitions to get a measure on the ballot in November making it more difficult to open military recruiting offices in Berkeley if they are near homes, parks, schools, churches, libraries or health clinics.
Some employees and business owners aren't happy with the weekly protests.
"My husband's business is right upstairs, and this (protesting) is bordering on harassment," Dori Schmidt told the council. "I hope this stops."
